SC2 General EULA (End User License Agreement)

0. Notes

This EULA superceeds, retroactively, all prior versions of this EULA.
Additionally, it applies to all current and prior versions of SC2, whether or
not they shipped with a EULA.

There are only two things which may alter the terms of this contract between
yourself (the user) and myself (Allen Landsidel, the author) and those two
things are:

  1. A newer EULA, authored by myself or my appointed representative.
  2. A custom license as described in topic 4.  All custom contracts/EULAs are
     immune to modification by subsequent releases of the "SC2 General EULA."

1. Copyrights

SC2 is Copyright 2001-2003 Allen Landsidel.  I, Allen Landsidel, reserve all
rights related to copyright, publishing and distribution.  All the normal rules
and laws related to copyrights apply, exceptions are noted in section 2.

Portions of SC2 are copyright by the following.

1995-2003, Microsoft Corporation.  Thanks Microsoft, for DirectX and DirectShow.

2002 Henri Gourvest.  Thank you Henri for your DSPack components.

Thomans G. Lane.  Thank you Thomas for your JPEG unit, included with Delphi.

1983-2001 Borland Software Corporation.  Thank you immensely for providing
Delphi, the greatest programming language and environment on Earth.

2003 Gustavo Huffenbacher Daud.  Thank you Gustavo for your TPNGImage library
and the PNG support it allowed me to add to SC2.

1993-2002, Chad Z. Hower (Kudzu) and the Indy Pit Crew @
http://www.nevrona.com/indy/ Thank you all for your invaluable work on the Indy
components, used in SC2 for FTP and HTTP support.  Get rid of the lame exception
throwing stuff though guys, please.

2. Copyright Exceptions, your rights.

SC2 is donationware.  You are provided a non-exclusive, royalty free license to
use SC2 in any noncommercial use, provided you meet the following criteria:

  - You read and agree to this EULA.
  - You distribute entire the SC2 package, unmodified, as I distribute it,
    should you decide to redistribute it; including this EULA.
  - You agree to not sue myself or any contributors to SC2 for any damages
    resulting directly or indirectly from the use of SC2.  This includes myself,
    names and entities listed above, as well as distributors and hosting services
    employed by SC2 to provide it to you.
  - In the event you decide to ignore and or violate the previous statement and
    sue myself or a contributor, you agree to pay all involved legal fees,
    including court and attorney costs.  In addition, you agree to pay a
    per-incident fee covering travel costs to and from court, meals, and lodging,
    the nature of which is entirely at the discretion of the defendant.  You also
    agree to pay any and all damages awared to you by the court on behalf of the
    defendant.
  - You agree to consider making a donation to Allen Landsidel, via the link
    provided in the helpfile, of any amount you deem appropriate.

SC2 is also donationware for commercial use, provided you meet all the
requirements stated for noncommercial use, in addition to the following:

  - You send an email to Allen Landsidel (all@biosys.net) describing the details
    of your application, so that I may include this information in promotional
    or other materials as a showcase for SC2.
  - Should SC2 prove indispensable, central, or otherwise "key" to your
    commercial application, you agree to compensate the author, Allen Landsidel,
    in a manner consistent with the success of your application.  In plain
    english, this means if you decide to sell and/or market something using SC2
    and start making decent money off it, you need to throw me some of that
    money; why should you make money off my hard work without compensating me?
  - You will provide Allen Landsidel with a licensed copy of your application for
    his personal, non-commercial evaluation and use.

Additionally, all users of SC2 agree that SC2 is a fluid "work in progress" and
is rapidly changing, including this EULA.  The capabilities and features of SC2,
as well as this EULA, may change at any time without notice.  If you are using
SC2 in a manner consistent with the latest version of the EULA that you posess,
upon notification by any party that a newer version of the EULA is available,
you will come into compliance with the new version of the EULA within thirty
days or cease using SC2, and remove all installed instances.

3. Copyright reservations, my rights.

I, Allen Landsidel, am the sole author and owner of SC2, excepting those other
copyright holders mentioned earlier in this document.  I reserve the right to
modify SC2, including all associated documentation and this EULA, at my
discretion.

I reserve the right to revoke or replace, at any time, the contents of this EULA
on a per user basis, as I see fit.  The term user shall be an all inclusive
moniker on a scale of my choosing, ranging from an individual to a corporation
to a government, and everything between and beyond those extremes.

4. In closing.

I intended this EULA to be easy to understand, agree to, and comply with.
Interpretation of this EULA is entirely at my discretion.  If you intend to use,
or are using SC2, and you have questions or doubts concerning or related to the
contents of this EULA, contact me.  I will evaluate your concerns and respond to
you in as timely a fashion as possible.

If this EULA is too restrictive or too vauge in parts, again, contact me.  I will
make every effort to work with people and organizations on a per case basis to
tailor a new license suitable to your requirements.

If You are a developer or development house and wish to puchase the exclusive or
nonexclusive rights to the source code of SC2, I am open to reasonable offers;
this includes outright payment of a lump sum for the source code, a royalty based compensation plan, or even employment to continue development as a commercial
endeavour.

If you are a distributor and/or publisher and wish to publish and/or market SC2,
I'm eager to hear from you.
